I am unsure if that is among the charges, Gurn;  I have not followed the story closely (just now and again when there is a short reference on the radio, my ears prick up).  I am against any finessed mitigation of the defendant's guilt.

Just my opinion, but it saddens me that, even though the Commonwealth has abolished the death penalty, it appears to be an option in this case, and it will have the look of Massachusetts disregarding its own abolition for vindictive reasons.  I suppose this aspect of the matter is partly why I am keeping at a distance.

The Feds are prosecuting Tsarnaev.  State laws regarding the death penalty do not apply.  Tsarnaev faces a good chance of being McVeighed.  While I do not support the death penalty, I can't say that I am overly troubled by the thought that he may be executed, either.
