Artists' Rights

The other Thread prompted me to ask the question concerning 'intellectual property', and royalties, and such like topics, and your opinions in such matters. What 'rights' do artists have?

All depends if they sold the rights to someone else. Since you are basing your question on performance artists, if that artist makes a contractual agreement with me to make a recorded performance, then that recorded performance is mine. If he/she doesn't like the performance after and doesn't want it released, that's really too bad. If I want to have a long-term relationship with that artist I might place releasing it in abeyance, but that isn't a legal or moral obligation, it's just good business if I want to make some money down the road. :)

Depends on the contract they sign, and the behavior of the counterparty in executing the agreement.  Artists are not so special as to deserve any special rights.

That isn't an either or question. The two options are not mutually exclusive.
